Breaking News: SCOTUS Rules on Biden's Vaccine Mandates

Earlier today, the U.S. Supreme Court (SCOTUS) issued two opinions related to the two federal vaccine mandates issued in 2021:

  • SCOTUS blocked OSHA's "vaccine or test" emergency temporary standard (ETS) for businesses of 100 employees or more. In its opinion, the Court said OSHA exceeded its authority when it issued this rule. This mandate would have impacted 84 million employees. With OSHA's rule struck down, the decision to mandate vaccination now falls on states and/or employers.You can read OSHA's response to the ruling here

  • SCOTUS upheld CMS' mandate of vaccines for health care workers. This mandate affects approximately 10.3 million healthcare workers. This ruling affects healthcare workers and employers in the 24 states where blocked by rulings in lower courts. Any healthcare providers who suspended or never implemented a vaccine mandate for employees must now comply.
